Doug McCallum, who was defeated in Saturday’s Surrey municipal election by 973 votes, is no longer conceding defeat.

In a statement released Monday evening, McCallum’s party — the Safe Surrey Coalition — stated “with less than a 1,000 vote difference, Mayor Doug McCallum is not conceding at this point in time.”

 
 

The party said that it had advisers reviewing Section 148 of the Local Government Act , that outlines rules for requesting a judicial recount through the Supreme Court of B.C.

Following the release of election results on Saturday, McCallum conceded defeat to Brenda Locke, who had secured 33,311 votes compared to McCallum’s 32,338.

The two had fought a pitched battle primarily over whether McCallum’s decision to replace the Surrey RCMP with a municipal force should continue.

As it stands, Locke has the balance of power with one vote — hers — as she has four councillors from her party on the eight-person council. Two of the remaining four councillors are with McCallum’s Safe Surrey Coalition, while the other two are with Surrey First.

If McCallum was successful in a recount, he would need the support of the two Surrey First councillors (Linda Annis and Mike Bose) in order for any of his motions to succeed. Annis, while serving on the previous council, was opposed to McCallum. Bose is newly elected.

The Safe Surrey Coalition’s statement came the day it was reported that the city-owned vehicle that had been driven by McCallum had been returned to a city works yard with considerable front-end damage .

According to Section 148 of the act, an application for a recount can be submitted to the court on the basis the votes were not correctly accepted, the ballot count does not record the number of valid counts or the final result did not take in all votes for the aggrieved candidate.

An application for recount must be made with nine days of the election.

Any request for a recount must be supported by a statement of facts on which the recount is requested, and must be supported by affidavits.

If the court decides to go ahead with a recount it must be done within 13 days of the election.

Canals Flats in the East Kootenay is expected to have a judicial recount for mayor after Mark Doherty and Doug McCuthen both received 158 votes.

In West Kelowna there is a recount expected for the sixth and final spot on council, that saw a one vote difference between Garrett Millsap and Tom Groat.
